General Terms And Conditions

1. Scope and supplier

These General Terms and Conditions apply to all orders placed in our online shop shop.nobis-printen.de. They apply accordingly to orders placed by telephone, email or order form (section 3).

A consumer is any natural person who places an order for purposes that are predominantly outside their trade, business or profession (Section 13 of the German Civil Code, BGB). A business customer is anyone who places an order in the course of their trade, business or profession (Section 14 BGB).

2. Conclusion of the contract in the online shop

The presentation of products in the shop is not yet a binding offer, but an invitation to order. This is how you order:

  1. Place the products you want in the basket with “Add to basket”. In the basket you can change quantities, remove products and add a greeting card.
  2. Click “Proceed to checkout” and enter your email address. You order as a guest or log in to your customer account. You then enter the billing and delivery address.
  3. Choose the shipping method, the payment method and, if you wish, a later shipping date.
  4. On the last page you see all details once more: products, prices, shipping costs, addresses, shipping and payment method.
  5. By clicking “Buy now” – or, when paying with PayPal, Apple Pay or Google Pay, by confirming in the window of the payment service – you submit a binding offer to purchase the products in the basket.

Correcting input errors: Until you submit your order, you can change all details – using “Change” next to the details on the last page, via the basket or with the back function of your browser. We check the input fields for completeness while you fill them in.

We confirm receipt of your order by email without delay (order confirmation). With this email we accept your offer; the purchase contract is thereby concluded.

Contract languages are German, English and French.

Storage of the contract text: We store your order with all details. You receive the order details by email with the order confirmation. You can view, save and print these terms and conditions on our website at any time. If you have a customer account, you will also find your orders under “My Account”. If you have lost your documents, we will be happy to send you a copy of your order details.

3. Orders by telephone, email or order form

You can also order by telephone, by email or with our order form. The contract is then concluded when we confirm your order or dispatch the goods. Please state recipient addresses completely and legibly, with postcode, street and house number. We process orders as soon as all details are available – buyer and recipient addresses and, if required, the texts for your greeting cards.

4. Prices and shipping costs

All prices are final prices including statutory VAT, plus shipping costs. The price at the time of ordering applies. For deliveries to countries outside the EU, German VAT does not apply; the basket then shows the price without VAT.

Shipping costs depend on the destination country and the order value (Germany) or the shipping weight. All prices are listed on the Shipment page; the basket shows the shipping costs for your order before you submit it. We do not charge a small-quantity surcharge.

For deliveries to countries outside the EU, customs duties, taxes and fees may be charged in the destination country. They are not included in our prices and shipping costs and are collected from the recipient.

5. Payment and retention of title

You can pay by credit and debit card, PayPal, Apple Pay, Google Pay and invoice. The checkout shows which payment methods are available for your order. Payment by invoice is only possible after your first successful order.

For payment by invoice, the invoice amount is due immediately upon receipt of the goods and the invoice, without deduction.

The goods remain our property until paid in full.

6. Delivery

We deliver to any address in Germany and to the countries available for selection at checkout. We cannot deliver to post office boxes.

The delivery time is stated for each product and for each country on the Shipment page. For payment by card, PayPal, Apple Pay or Google Pay it begins on the day after payment, for payment by invoice on the day after the contract is concluded. If the last day falls on a Saturday, Sunday or public holiday at the place of delivery, the period is extended to the next working day.

If you choose a preferred shipping date at checkout, we will not send the parcel before that day; the delivery time then begins on that day.

Order dates: We bake by hand and without a large stock. Please order in good time, especially before Christmas – about three weeks before the desired arrival date in Germany and Europe, four weeks for shipping outside Europe. Remember that many recipients travel over the holidays. We process orders in the order in which they are received.

If a parcel cannot be delivered because of incorrect or incomplete address details, it is returned to us. We may then charge the costs of the return and of sending it again. The same applies if a parcel is not collected despite notification. We will inform you in these cases.

7. Right of withdrawal for consumers

You have the right to withdraw from this contract within 14 days without giving any reason.

The withdrawal period will expire after 14 days from the day on which you acquire, or a third party other than the carrier and indicated by you acquires, physical possession of the goods or, if several goods are delivered separately, of the last good.

To exercise the right of withdrawal, you must inform us (Nobis Printen e.K., Charlottenburger Allee 30, 52068 Aachen, Germany, phone: +49 241 96 80 00, email: info@nobisprinten.de) of your decision to withdraw from this contract by an unequivocal statement (e.g. a letter sent by post or email). You may use the attached model withdrawal form, but it is not obligatory. You can also exercise your right of withdrawal online at shop.nobis-printen.de/Online-Widerrufsformular_1. If you use this online function, we will send you without delay, on a durable medium (e.g. by email), an acknowledgement of receipt with information on the content of your withdrawal and the date and time of its receipt.

To meet the withdrawal deadline, it is sufficient for you to send your communication concerning your exercise of the right of withdrawal before the withdrawal period has expired.

Effects of withdrawal

If you withdraw from this contract, we shall reimburse to you all payments received from you, including the costs of delivery (with the exception of the supplementary costs resulting from your choice of a type of delivery other than the least expensive type of standard delivery offered by us), without undue delay and in any event not later than 14 days from the day on which we are informed about your decision to withdraw from this contract. We will carry out such reimbursement using the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise; in any event, you will not incur any fees as a result of such reimbursement. We may withhold reimbursement until we have received the goods back or you have supplied evidence of having sent back the goods, whichever is the earliest.

You shall send back the goods or hand them over to us without undue delay and in any event not later than 14 days from the day on which you communicate your withdrawal from this contract to us. The deadline is met if you send back the goods before the period of 14 days has expired.

You will have to bear the direct cost of returning the goods.

You are only liable for any diminished value of the goods resulting from the handling other than what is necessary to establish the nature, characteristics and functioning of the goods.

Exclusion of the right of withdrawal

The right of withdrawal does not apply to contracts

  • for the supply of goods which are made to the consumer’s specifications or are clearly personalised,
  • for the supply of goods which are liable to deteriorate or expire rapidly,
  • for the supply of sealed goods which are not suitable for return due to health protection or hygiene reasons and were unsealed after delivery.

8. Warranty and transport damage

The statutory rights in respect of defects apply. If a parcel arrives damaged, please contact us as soon as possible and, if possible, also point out the damage to the delivery person. This helps us to settle the damage with the shipping company; your statutory rights do not depend on it.

9. Shelf life and storage

We bake our Printen and biscuits without preservatives; they are intended to be enjoyed soon. The best-before date is printed on the packaging. Please store the products in a dry, cool place away from sunlight.

10. Gift vouchers

You receive gift vouchers as a PDF by email as soon as your payment has reached us. You may print them or pass them on; vouchers are transferable.

Vouchers can only be redeemed in our online shop, in the last step of checkout – not in our bakeries. If the voucher does not cover the whole order, you pay the rest with one of the payment methods offered. Any remaining balance stays on the voucher and can be used for a later order. Vouchers cannot be exchanged for cash.

Vouchers are valid for four years from issue; the expiry date is printed on the voucher.

Please treat the voucher code like cash: anyone who knows the code can redeem it. We are only liable for loss or misuse of the code if we are responsible for it.

The right of withdrawal under section 7 applies to the purchase of vouchers. If you withdraw from the purchase, we block the voucher and refund the purchase price, less any amount already redeemed.

11. Business customers and large orders

For large shipping volumes, we will be happy to offer you individual terms. We can also deliver the parcels together to a place of your choice – by forwarding agent, by post or with our own delivery service – or ship via your own shipping provider.

If the customer is a business customer, the following also applies: the risk passes to the customer when the goods are handed over to the shipping company. Obvious defects must be reported to us without undue delay after receipt of the goods; Section 377 of the German Commercial Code (HGB) remains unaffected.

12. Dispute resolution

We are neither willing nor obliged to participate in dispute resolution proceedings before a consumer arbitration board.

13. Final provisions

The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods. For consumers, this choice of law applies only insofar as it does not deprive them of the protection granted by the mandatory provisions of the law of the country in which they have their habitual residence. If the customer is a merchant, a legal entity under public law or a special fund under public law, the place of jurisdiction is Aachen.
